CONTRACT CONDITIONS

This text constitutes the CONTRACT that will govern the relationship between CM OPTICAL BRAND, S.L. (hereinafter, "CARL MARTIN"), with Tax ID B21839881, registered office at C. Chile, 7, 06360 Fuente del Maestre (Badajoz) and You (the USER), when browsing the websites owned by CARL MARTIN and making any payment through its platform.

Read this document carefully. Here you will find the conditions that govern contracting and purchasing through our website, the rights and obligations of both parties, and information about the purchase process procedures, among other matters.

We inform you that these Conditions comply with the provisions of Law 34/2002, of July 11, on information society services and electronic commerce (hereinafter, "LSSICE"), Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws (hereinafter, "Consumer and User Law") and other current legislation on the matter.


1. ACCEPTANCE AND VALIDITY OF THE CONDITIONS

These Conditions are mandatory for both parties. The USER will be bound by each and every one of these Purchase Conditions without any reservation when contracting products/services through CARL MARTIN, being their obligation and responsibility to read them beforehand.

During the course of your order, before authorizing payment, the USER must accept the Purchase Conditions. If you do not agree with them, do not continue with the contracting process, since these conditions will apply to you in any case.


2. PURCHASE PROCESS

To purchase a product at CARL MARTIN, you must follow the process detailed below:

1º.- Access the products or services available in the different sections of the CARL MARTIN website.
2º.- Select the products you wish to purchase by clicking on the "Add to cart" button.
3º.- The shopping cart will appear on your screen so you can choose to continue selecting products or proceed to checkout.
4º.- Personal Data: To continue with your order, you will be asked for the following information: Name, Surname and Email address. You will also be given the option to create an account (optional) by providing a password that will be associated with your email to create an account at CARL MARTIN so you can track your entire order. If the user already has an account with us, they can log in directly.
5º.- Addresses: Next, the data we need to send your order will appear on your screen. You will have the option to modify the delivery address if it is different from the billing address.
6º.- Shipping method: In the next step, you must select the shipping method you want. Please note that depending on the option chosen, there may be an additional cost that will be shown on your screen. You can also leave us an additional comment if you think the delivery person should take something into account.
7º.- Payment: Select the payment option available for your choice and follow the corresponding instructions to make the payment.
8º.- Acceptance of legal conditions: To continue with the process, the user must read our contracting conditions and privacy policy, and accept them by checking the corresponding box if they agree. We remind the user that clicking this button will imply acceptance of our legal conditions, being bound and obligated to them.
9º.- If you have made errors in entering the data, the system itself will prevent you from continuing and the form will show the corresponding notice indicating the errors to be corrected.
10º.- Confirmation of completion of the purchase process: Once the payment process is completed, you will automatically receive a confirmation from CARL MARTIN in your email with all the details of your purchase and the data to track your order. If you have not received this confirmation, you must send us an email to carlmartin@carlmartin.me


3. PRICE AND SHIPPING COSTS

All prices of products and services offered on the website www.carlmartincm.com are expressed in Euro currency (€) and include the corresponding Value Added Tax (VAT).

The price corresponding to each product will be the one specified on the website at any given time.

CARL MARTIN reserves the right to modify prices and sales conditions based on market demand fluctuations. However, the price and conditions that were established at the time you placed your order will always be respected and applied.

Shipping costs (when applicable) are not included in the product prices. In cases where they apply, they will be indicated before making the purchase.

5. USER RIGHTS

Delivery
CARL MARTIN will only supply products that are in stock. For unavailable products, you can inquire through the purchase form or by email.

Standard delivery time: 1 to 5 business days in Spain. If the term is longer, we will contact the customer.

Warranties

The provisions of Royal Legislative Decree 1/2007 on legal warranties for consumers will apply.

Returns
The USER may exchange an order as long as it has not been shipped and does not fall under one of the exceptions to the right of withdrawal. All returns will be processed by email to carlmartin@carlmartin.me. The costs will be borne by the customer.

Withdrawal
The general period to exercise the right of withdrawal is 14 calendar days.
Exceptions according to art. 103 LCU: customized products, sealed goods opened for health/hygiene reasons.


6. USER SATISFACTION

If the USER is not satisfied with the product received, they must contact CARL MARTIN by email. The claim will be evaluated and, if applicable, a refund or alternative will be offered.

The refund of the amount, if applicable, will be made through the same payment method used.


7. LIABILITIES

CARL MARTIN is not responsible for misuse of the website by the USER, nor for technical failures, viruses or other external factors that affect the operation of the store.


8. INTELLECTUAL AND INDUSTRIAL PROPERTY

All content of the website, products, logos and designs are property of CARL MARTIN or its licensors. Their reproduction is prohibited without express authorization.


9. APPLICABLE LAW AND JURISDICTION

In accordance with EU Regulation No. 524/2013, the USER has the right to use an out-of-court dispute resolution platform accessible at: https://ec.europa.eu/consumers/odr/

Both parties submit to Spanish law and to the Courts and Tribunals of the registered office of CM OPTICAL BRAND, S.L., unless mandatory legal provisions dictate otherwise.


10. UPDATES

CARL MARTIN reserves the right to modify these Contracting Conditions at any time. In such case, users will be notified by publishing them on the website.
